Shock Vote as California City Plans to SUE State Over Sanctuary Laws

Over the last month, we’ve seen the small town of Los Alamitos vote to ignore California’s sanctuary policies and we’ve seen Orange County decide to throw their lot in with a Justice Department lawsuit against the California government. But not until this week has a city gone this far. The Huntington Beach city council voted 6 to 1 this week to sue California over the newly-implemented sanctuary laws, which restrict local law enforcement officials from cooperated with federal immigration authorities. If Huntington Beach moves forward with the lawsuit, it will be the first city in California to sue Sacramento over the controversial new law.

“We hoped that a majority of our colleagues will agree with Mayor pro-tem Peterson and I that we want the city attorney to file a suit against the state of California to exempt us from SB54,” said Huntington Beach Mayor Mike Posey. “We’re not going to be writing an ordinance, we’re not going to be doing something like that. We’re suing on the constitutional overreach grounds.”

According to the Orange County Register, the city council has encouraged the city attorney “to work with the county or other municipalities that wish to join our efforts,” yet another indication that this move against California’s outrageous law could gain steam in the coming weeks and months. Mission Viejo and Yorba Linda have already expressed support for the Trump administration as it pertains to the upcoming legal battle. City officials in Fountain Valley and Fullerton are also scheduled to soon weigh in on the controversy.

By all accounts, Sacramento’s Democrats have bitten off more than they can chew this time.

As for the Huntington Beach City Council meeting on Monday, the Los Angeles Times reports that the audience was filled with Trump supporters who waved signs and clothed themselves in “Make America Great Again” memorabilia. They listened to more than 100 speakers, including Rep. Dana Rohrabacher, speak out about the importance of standing up to California’s dangerous new sanctuary policies.

One such speaker was nearby resident Gerald Thomas, originally from the Philippines, who is one of many legal immigrants who has grown frustrated with the unbelievable entitlement seen in this generation of immigration activists and, um, shall we say, undocumented arrivals.

“Nobody offered us sanctuary or an easier way,” he told the council. “If I can do it, everyone who came here illegally can do it too. It’s a personal insult if they think they can bypass our laws.”

And that goes double for the Democrats in the state legislature.

  1. The governor of California has lost all touch with reality. First, he thinks the state has a right to ignore national laws. He recently pardoned five illegal immigrants who were all violent offenders or drug dealers. This debate is not about immigration, it’s about one delusional man who has bankrupted his own state, by providing enormous amounts of illegal aliens, whom he welcomes, and disregarding all of those who came into this country legally and obtained citizenship. He is mocking the legal immigrants, by welcoming all of the illegal immigrants. This is issue, but he doesn’t want to talk about that, he has his own agenda.

    • Does he welcome them in2 his home? does he have armed security? if the answer is no 2 these questions., he is just another filler of Stalin trying 2 destroy the country,

    • Citizens of so called sanctuary cities should demand that the leaders of their communities stop protecting criminals! if they don’t they can sit and wonder how long it will be before their daughter will be beaten, raped and murdered, like Kate Steinle was or some other family member murdered! You don’t know who these people are or where they are, they could be your next door neighbor or living nearby! You must do this or the criminals will outnumber the good American citizens where you live!

  2. JERRY BROWN is a COMMUNIST………
and mentally disturbed…….HE PROVED THAT WHEN HE STARTED DTOING RONSTADT……HED WAS HER ‘MOONBEAM’…….
WHAT A CROCK……and the jerks that voted him in the second time……
he’s another proof that you cannot fix ‘STUPID’………………..
the California democrat legislature is ANOTHER……
    ‘STUPID CANNOT BE FIXED’……….democrats prove that EVERYDAY………24 – 7 – 365 ………

    • Dennis, just keep pushing, everything say is what the sane people in Mexi-cal think. We are all in this together. Take care.

  3. The “Supremacy Clause” vs. Sanctuary Venues

The “Supremacy Clause” dictates that the Constitution and federal laws are superior to state law.
It appears that state and local laws establishing Sanctuary venues conflict with federal law and as such appear to be illegal.

Further, it appears appropriate and logical for the Justice Department to select a single venue and sue that venue’s politicians who apparently violated their Oaths of Office by voting for sanctuary status. The suit should ask for voiding all sanctuary votes and for the assessment of maximum penalties against those politicians.

Subsequent to success, the Justice Department should offer other sanctuary venues thirty days to reverse their sanctuary status without any penalties, if done so within the thirty days without any extensions. Those politicians of those venues that support and defend the targeted venue will not be allowed the 30-day grace period.

I recommend that the target venue be Governor Brown, California, et al, assuming that the governor signed sanctuary legislation promulgated by the Assembly and Senate. The suit would be joined by those cities within California who have objected to the sanctuary concept.

    • Bravo and fantastic explanation. Of course anyone who listened in high school would hopefully know this. Well maybe not nowadays but in my day. Thank you.

    • MODIFIED:

The “Supremacy Clause” vs. Sanctuary Venues

The “Supremacy Clause” (see Article VI, Paragraph 2, below) dictates that the Constitution and federal laws are superior to state law.

It appears that state and local laws establishing “sanctuary” venues conflict with federal law and as such appear to be subordinate and possibly illegal.

Further, it appears appropriate and logical for the Justice Department to select a single venue and sue that venue’s politicians who apparently violated (see Article VI, Paragraph 3, below) their Oaths of Office by voting for sanctuary status. The suit should ask for voiding all sanctuary votes and for the assessment of maximum criminal and civil penalties against those politicians.

Subsequent to success, the Justice Department should offer other sanctuary venues thirty days to reverse their sanctuary status without any penalties, if done so within the thirty days without any extensions and apologize to their citizens.

The citizens should sue the politicians for the violation of their fiduciary responsibilities by taking funds (embezzling) from the state for purposes other than for its citizens.

Every one of the 7 billion humans on this planet has the right to make any and all efforts to improve his or her life and the lives of his or her family, but must adhere to the law.

Article VI (Article 6 – Prior Debts, National Supremacy, Oaths of Office)
1: All Debts contracted and Engagements entered into, before the Adoption of this Constitution, shall be as valid against the United States under this Constitution, as under the Confederation.
2: This Constitution, and the Laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land; and the Judges in every State shall be bound thereby, any Thing in the Constitution or Laws of any State to the Contrary notwithstanding.
3: The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution; but no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States.

      Food for thought………………..

  4. Contact your legislators demand that they pass a federal law that makes aiding and abetting the criminal aliens a felony, carrying a mandatory, minimum 4 year sentence, with out the possibility of parole.
Let;s see if the liberal dem bloodsuckers want the illegal votes badly enough to go to jail and then lose their right to vote as convicted felons.

  5. I believe that more and more cities will join the fight against the radical left leaders of California. One thing I thought unusual was the majority of cities that are band together to fight against sanctuary laws are all from Orange, and San Diego counties according to a map they showed on Fox News last night

  6. They can’t have it both ways! If California chooses to disobey federal law, they should be prevented from availing themselves of federal funds.

  7. WE ARE FROM ‘L.A.’ CALIF. >*LAW ENFORCEMENT* PREVIOUSLY DECLARED (at Street level to Citizens) THE COPS ARE *LOSING* THE *WAR* ON *VIOLENT CRIME* COMING IN FROM *ILLEGALS* > ESPECIALLY *ILLEGALS TERRORIST ORGS.* OF ‘VARIOUS TYPES’ INCLUDING BUT NOT LIMITED TO *ISLAM* ! THIS IS FAR MORE THAN THE *RAD-LIB* ‘MEDIA PHOTOS’ OF FAMILIES!!!
COPS SAID: (1) LEAVE CALIF. (2) GET FIREARMS TRAINING IF YOU STAY (3) COPS ARE MOVING THEIR FAMILIES OUT OF MAIN AREAS OF L.A. CA. (4) COPS HANDS ARE TIED BY *ROGUE* STATE ‘ GOVERNOR’ & ‘MAYORS’ & POLICE ‘ CHIEFS’!!! FACT !!! *WE LEFT* (2018) AFTER BEING THERE SINCE 1972!!!

  8. The Constitution clearly says Congress shall make the laws about immigration and naturalization.

BUT, BEWARE! There’s a trap here. There are only a few things that the Constitution gives Washington the power to boss the States around. This is a sword that cuts both ways. The Usual Suspects stand to gain either way this goes if it is not according to the Constitution.

  9. A BEGGAR HAS NO CHOICE. Other countries control those protesting and DEMAND Citizenship they have not earned by entering illegally and breaking laws. They are responsible for throwing all trash of old mattresses on Highways making the cities dirty. They are drunkards running down street signs and street lights. They are famous for hit and runs and then disappear South only to re emerge and start their s**t again. They DEMAND but not formally explain why they shouldbe allowed to stay. Ba*****s!!!

  10. I believe that the majority of legal California citizens voted for Trump and we are a RED state but due to voter fraud and corruption here we the people have our hands tied. I’m hoping many many more cities join in this fight.this is the only way we’re going to clean out the communist crooks.

  11. Don’t sue the state, where do you think the money would come from to pay for suit?… you guessed it the tax payers.
